| 2. | Employers should apply for work permit for employees from taiwan , hong kong or macaw if they intend to employ or accept them ( hereinafter referred to the employment permits )
用人单位拟聘雇或者接受被派遣台、港、澳人员的，应当为其申请办理《台港澳人员就业证》 （以下简称就业证） ；香港、澳门人员在内地从事个体工商经营的，应当由本人申请办理就业证。 |
| 3. | 4 for foreigners who work without the employment permit , the administrative department of the public security organs in charge of the entry and exit of aliens is authorized to terminate the employment and impose a fine of under 1 , 000 rmb yuan
外国人未经批准私自谋职，公安机关出入境管理部门将在终止其任职或就业的同时，可以处1000元以下的罚款，情节严重的，并处限期离境。 |
| 4. | Article 13 in case an employment permit is lost or destroyed , the employing entity shall apply to the administrative department of labor and social security that issued the said permit for re - issuing a new employment permit for the person from taiwan , hong kong or macaw
第十三条就业证遗失或损坏的，用人单位应当向颁发该证的劳动保障行政部门申请为台、港、澳人员补发就业证。 |
| 5. | In case the employing entity is altered , the employing entity upon alteration shall apply to the local administrative department of labor and social security at the prefecture ( municipal ) level for another employment permit for the person from taiwan , hong kong or macaw
用人单位变更的，应当由变更后的用人单位到所在地的地（市）级劳动保障行政部门为台、港、澳人员重新申请办理就业证。 |
| 6. | When a person from hong kong or macaw who engages in the private business in the mainland suspends or shuts down his businesses , he shall cancel the employment permit at the organ that originally issued the permit within 30 working days upon the suspension or shutdown
在内地从事个体工商经营的香港、澳门人员歇业或者停止经营的，应当在歇业或者停止经营之日起30日内到颁发该证的劳动保障行政部门办理就业证注销手续。 |
| 7. | Article 10 in case a person from hong kong or macaw engages in the private business in the mainland , he shall , upon the strength of household business license , his health certificate and effective travel permit , apply to the local administrative department of labor and social security at the prefecture ( municipal ) level for an employment permit
第十条香港、澳门人员在内地从事个体工商经营的，由本人持个体经营执照、健康证明和个人有效旅行证件向所在地的地（市）级劳动保障行政部门申请办理就业证。 |
| 8. | Article 12 when an employing entity terminates or dissolves a labor contract with any person from taiwan , hong kong or macaw , or when the employment term of any person from taiwan , hong kong or macaw expires , the employing entity shall g cancel the employment permit at the organ that originally issued the permit within ten working days upon termination or dissolution of the labor contract or upon expiration of the employment term of the person from taiwan , hong kong or macaw
第十二条用人单位与聘雇的台、港、澳人员终止或者解除劳动合同，或者被派遣台、港、澳人员任职期满的，用人单位应当自终止、解除劳动合同或者台、港、澳人员任职期满之日起10个工作日内，到原发证机关办理就业证注销手续。 |
| 9. | Article 17 in case an employing entity fails to cancel the employment permit when it terminates or dissolves a labor contract with any person from taiwan , hong kong or macaw or when the employment term of any person from taiwan , hong kong or macaw expires , it shall be ordered to make corrections by the administrative department of labor and social security , and a fine of 1000 yuan may be imposed
第十七条用人单位与聘雇台、港、澳人员终止、解除劳动合同或者台、港、澳人员任职期满，用人单位未办理就业证注销手续的，由劳动保障行政部门责令改正，并可以处1000元罚款。 |
| 10. | If the conditions as prescribed by article 6 of these regulations are met , the administrative department shall approve the employment and issue an employment permit ; if the conditions as prescribed by article 6 of these regulations are not met , the administrative department shall disapprove the employment and notify the disapproval to the employing entity in written form and explain the reasons
对符合本规定第六条规定条件的，准予就业许可，颁发就业证；对不符合本规定第六条规定条件不予就业许可的，应当以书面形式告知用人单位并说明理由。 |
